TERMS OF SERVICE

(hereinafter referred to as the “Seller”)


These Terms of Service govern the rights and obligations between the Seller and the Buyer when purchasing digital content (online courses and memberships) or physical products (castanets) through the online store New Castanets Shop at https://newcastanets.shop (the “E-shop”).

 

1. INTRODUCTORY PROVISIONS

1.1 The Buyer is a natural or legal person who enters into a purchase agreement with the Seller via the E-shop.

1.2 Legal relationships not covered by these Terms are governed by Czech law – in particular Act No. 89/2012 Coll., the Civil Code, and Act No. 634/1992 Coll., on Consumer Protection.

1.3 By submitting an order, the Buyer confirms that they have read, understood, and agreed to these Terms of Service.

 

 

2. SUBJECT OF PURCHASE

 

2.1 Digital content (online course and membership)

Upon payment, the Buyer gains access to the online castanet course and/or monthly membership, including access to the community and learning materials.

The digital content is protected by copyright law and intended for the Buyer’s personal use only.

Sharing, uploading to the Internet, or using the materials to teach others without written consent from the author is strictly prohibited.

 

2.2 Physical products (castanets)

Castanets are handcrafted originals, and minor variations in color or texture are natural and do not affect quality, sound, or functionality.

If castanets are currently sold out, they can be made to order, with an estimated production and delivery time of approximately 30 days.


3. ORDER AND CONTRACT CONCLUSION

3.1 Orders can be placed via the E-shop interface. Before submitting, the Buyer must review and confirm all entered information.

3.2 The purchase contract is concluded once the Seller confirms the order by e-mail (“order confirmation”).

3.3 The Buyer agrees to the use of remote communication means. Any related costs (internet connection, etc.) are borne by the Buyer.


 

4. PRICES AND PAYMENTS

 

4.1 All prices are listed in CZK, EUR, and USD and are final.

The Seller is not a VAT payer in the Czech Republic but is an identified person for VAT purposes under §6g of Act No. 235/2004 Coll. (on VAT).

This means that:

  • For sales of goods or digital services within the EU, VAT may be remitted in the customer’s country (under the OSS system).
  • For sales outside the EU, no VAT is charged.
  • Prices displayed for Czech customers are without VAT.

 

4.2 Payments can be made by credit/debit card, via Shopify Payments, PayPal, or other available methods.

All payments are processed through secure payment gateways.

4.3 The Buyer receives an electronic invoice after payment.

4.4 Prices and product availability may change without prior notice.


 

5. DELIVERY

 

5.1 Digital products

After successful payment, login credentials or access links are sent to the Buyer’s e-mail within 24 hours at the latest.

 

5.2 Physical products

Products are shipped via verified carriers (DHL Express, Zásilkovna, or other partners).

  • Items in stock are usually shipped within 5 business days.
  • Made-to-order items are shipped within approximately 30 days after payment.

 

5.3 Customs and import duties

For international orders, customs duties and import taxes may apply depending on the laws of the Buyer’s country.

 

5.4 Transfer of risk and ownership

The risk of damage and ownership transfer to the Buyer upon receipt of the shipment.

 

6. WITHDRAWAL AND RETURNS

6.1 Consumers have the right to withdraw from a distance contract within 14 days of receiving the goods without giving any reason.

6.2 To withdraw, send an e-mail to info@newcastanets.com, including your order number and bank account details for refund.

6.3 The returned goods must be undamaged and in original packaging, sent to:

6.4 Return shipping costs are covered by the Buyer. The refund will be issued within 14 days of receiving the returned item or proof of shipment.

6.5 Digital content (course, membership): By explicitly requesting immediate access to digital content, the Buyer agrees to waive the 14-day withdrawal right under Article 16(m) of the EU Consumer Rights Directive.

 

7. WARRANTY AND CLAIMS

7.1 Castanets come with a 24-month legal warranty covering manufacturing defects.

7.2 Slight variations in shape or color are natural and do not constitute defects.

7.3 To file a claim, contact info@newcastanets.com and include photo documentation. After approval, send the item to the address listed in section 6.3.

7.4 Claims are processed within 30 days of receipt.

 

8. COPYRIGHT AND INTELLECTUAL PROPERTY

All course content and website materials are the intellectual property of Johanka Valášková and protected by copyright law.

Buyers may use the purchased content for personal purposes only and may not reproduce, distribute, or use it for teaching without the author’s written consent.

 

9. LIABILITY

The Seller is not responsible for temporary technical issues, website downtime, or how the Buyer uses the purchased products.

Use of digital content is at the Buyer’s own discretion and responsibility.

This does not affect statutory consumer rights.

 

10. PERSONAL DATA PROTECTION

The Seller processes personal data in accordance with Regulation (EU) 2016/679 (GDPR).

By purchasing, the Buyer agrees to receive informational e-mails with an unsubscribe option included in each message.

 

11. DISPUTE RESOLUTION AND GOVERNING LAW

Disputes are primarily resolved amicably via info@newcastanets.com.

Consumers have the right to contact the Czech Trade Inspection Authority (www.coi.cz) or use the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr/.

These Terms are governed by the laws of the Czech Republic.

Czech courts shall have jurisdiction over any disputes arising from these Terms.

 

12. FINAL PROVISIONS

These Terms of Service are valid and effective from October 16, 2025, and available at https://newcastanets.shop/terms-of-service.

The Seller reserves the right to update or amend these Terms in accordance with applicable legislation or changes
